SOS Calmia – Terms of Service

These Terms of Service (“Terms”) govern your use of the SOS Calmia mobile application (“the App”). The App is developed and published by Jean-François Théberge (“I”, “me”, “my”).

By downloading or using SOS Calmia, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Description of the Service

SOS Calmia provides short guided audio practices, breathing exercises, and other wellbeing content designed to help users manage moments of stress and anxiety. The App is intended for general wellbeing and relaxation only.
It does not provide medical, psychological, or psychiatric advice, diagnosis, or treatment.

2. Health and Safety Disclaimer
  • SOS Calmia is not a substitute for professional medical care, mental health services, or therapy.

  • If you have or suspect you have a medical or mental health condition, you should consult a qualified healthcare professional.

  • If you experience strong emotional distress, intense anxiety, thoughts of self-harm, or feel unsafe, you should immediately contact your local emergency number or a crisis hotline.

By using the App, you acknowledge that you are responsible for your own physical and mental health and that you use the content at your own discretion.

3. Eligibility

By using SOS Calmia, you confirm that:

  • you are legally allowed to enter into these Terms in your country or region, and

  • you will use the App only for personal, non-commercial purposes.

The App is primarily designed for adult users.

4. Subscriptions and Payments

SOS Calmia may offer paid subscriptions that unlock additional content or features.

  • All purchases and subscriptions are processed by the Apple App Store and/or Google Play Store, not directly by me.

  • By starting a subscription, you agree to the relevant store’s terms and payment policies.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period, meaning they renew automatically at the end of each billing period unless you cancel them in your store account settings.

  • You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings on your device.

I do not manage refunds directly. Any refunds are handled according to Apple’s and Google’s policies.

5. License and Permitted Use

I grant you a limited, non-exclusive, non-transferable, revocable license to use SOS Calmia solely for your personal, non-commercial use and strictly in accordance with these Terms.

You agree not to:

  • copy, modify, or distribute the App or its content, except as allowed by law

  • reverse engineer, decompile, or attempt to extract the source code

  • use the App for any illegal purpose or in violation of any applicable law or regulation

  • use the App in a way that could damage, disable, or overburden the App or its infrastructure.

 

6. Intellectual Property

All content in SOS Calmia, including but not limited to audio recordings, text, graphics, logos, and design, is owned by or licensed to Jean-François Théberge and is protected by copyright and other intellectual property laws.

You may not use any part of the App’s content for commercial purposes without my prior written permission.

7. User Content and Feedback

If you send feedback, suggestions, or ideas about SOS Calmia (for example by email), you agree that:

  • I may use this feedback to improve the App or create new services,

  • I am not obliged to use or compensate you for this feedback, and

  • you grant me a non-exclusive, worldwide, royalty-free license to use the feedback in any manner.

 

8. Third-Party Services

The App may rely on third-party services such as app stores, hosting providers, or analytics tools.
These services are governed by their own terms and privacy policies. I am not responsible for third-party services or content.

 

9. Termination

You may stop using SOS Calmia at any time by uninstalling the App from your device and, if applicable, cancelling your subscription in your store account settings.

I may suspend or terminate your access to the App if:

  • you seriously or repeatedly breach these Terms, or

  • I decide to stop providing the App, in which case I will take reasonable steps to inform users in advance where possible.

 

10. Disclaimer of Warranties

SOS Calmia is provided “as is” and “as available” without any warranties of any kind, either express or implied, including but not limited to warranties of fitness for a particular purpose, reliability, or availability.

I do not guarantee that:

  • the App will be free of errors or interruptions, or

  • that any particular outcome (for example, reduction of anxiety) will result from using the App.

 

11. Limitation of Liability

To the maximum extent permitted by law:

  • I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising out of or related to your use of SOS Calmia.

  • My total liability for any claims arising out of or relating to the App or these Terms will be limited to the amount you paid (if any) for using the App in the 3 months before the claim arose.

Some jurisdictions do not allow certain exclusions or limitations of liability, so parts of this section may not apply to you. In such cases, the liability will be limited to the minimum permitted by law.

12. Changes to These Terms

I may update these Terms from time to time. When I do, I will update the “Last updated” date at the top of this page.

If you continue to use SOS Calmia after the Terms have changed, you are considered to have accepted the updated Terms.

 
13. Content Assistance

A portion of the meditation scripts and written material in SOS Calmia was developed using AI (ChatGPT) as a creative assistant. Every text has been manually reviewed and refined by our team to ensure clarity, quality, and emotional safety for our users
